1.1. These Terms & Conditions ("Terms") govern your access to and use of the Sticky Beans website (stickybeans.co.za) and the purchase of products from Sticky Beans ("the Company", "we", "us").

1.2. By browsing our website, creating an account, or placing an order, you agree to be bound by these Terms in full. If you do not agree, please do not use our website or services.

1.3. We reserve the right to amend these Terms at any time. Changes take effect immediately upon posting to this page.

2.1. You may use our website for lawful purposes only. You agree not to interfere with the security of, or otherwise abuse, the site or any systems connected to it.

2.2. All content on this website — including images, text, logos, product descriptions, and recipes — is the intellectual property of Sticky Beans or its licensors and is protected by South African and international copyright laws.

2.3. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent.

3.1. We make every effort to display products, descriptions, and pricing as accurately as possible. However, we do not warrant that product descriptions or other content on the site are error-free.

3.2. All prices are listed in South African Rand (ZAR) and include VAT where applicable.

3.3. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and refund any amounts paid.

4.1. Placing an order constitutes an offer to purchase. Acceptance occurs only when we confirm the order via email or WhatsApp and process payment.

4.2. We accept electronic funds transfer (EFT) and secure third-party payment processing. Full payment is required before dispatch.

4.3. We reserve the right to refuse or cancel any order for reasons including stock unavailability, suspected fraud, or breach of these Terms.

5.1. Shipping terms are governed by our Shipping Policy. Risk in the goods passes to you upon delivery to the courier.

5.2. Delivery timeframes are estimates only. We are not liable for delays caused by courier services, weather events, or other circumstances beyond our reasonable control.

6.1. All sales are final. We operate a strict no-returns and no-refunds policy except where goods are materially damaged or defective.

6.2. The full damaged-goods reporting protocol is set out in our Refund & Returns Policy. Claims must be submitted within 48 hours of delivery with supporting evidence.

7.1. Your use of our website is also governed by our Privacy Policy (POPIA), which explains how we collect, use, and protect your personal information.

7.2. By using our services, you consent to the processing of your personal data as described in the Privacy Policy.

8.1. To the maximum extent permitted by applicable law, Sticky Beans shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the website or purchase of products.

8.2. Our total liability for any claim arising from your order shall not exceed the total amount paid for that order.

8.3. Nothing in these Terms limits or excludes liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under South African consumer protection law.

9.1. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

9.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
